Terms of Service

This Terms of Service Agreement (“Agreement”, “Terms”) constitutes a legally binding agreement between the customer (“Customer”, “User”, “Client”, “you”) and Sparky Host (“Sparky Host”, “we”, “our”, “us”), operated by Rudra Kapoor, based in Ludhiana, Punjab, India.

By purchasing, registering, accessing, or using any Sparky Host service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Scope & Nature of Services

Sparky Host provides high-performance hosting and cloud infrastructure, including:

  • Game Server Hosting: Minecraft, Rust, SA-MP, FiveM, Palworld, ARK, and related gaming titles.
  • Application & Bot Hosting: Node.js, Python, Java, Discord & Telegram bots with PM2 process supervision.
  • Web Hosting: cPanel/web containers, domain routing, and automated SSL.
  • Virtual Private Servers (VPS) & Cloud: High-frequency compute slices, KVM virtualization, and Windows RDP instances.

All services are provided on a commercial best-effort basis subject to our Service Level Agreement.

Operator Identity & Governing Law

Sparky Host is operated and managed by Rudra Kapoor, having its principal place of administration in Ludhiana, Punjab, India.

This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Republic of India. The parties irrevocably submit to the exclusive jurisdiction of the competent courts located in Ludhiana, Punjab, India for any legal proceedings or arbitration.

Account Registration & Security

You must provide accurate, current, and complete registration information when creating an account on Sparky Host. Customers are solely responsible for safeguarding passwords, API tokens, and access credentials. Any actions conducted under your account are your sole responsibility.

Payments, Billing & Currencies

All services are billed in advance on a recurring monthly or custom cycle. Supported payment currencies include INR (₹) and USD ($) processed via secure certified payment partners (including Cashfree for UPI, debit/credit cards, and netbanking).

Invoices are generated prior to the service renewal due date. Customers must maintain a valid payment method or complete invoice checkout promptly to prevent service disruption.

Suspension on Due Date & 7-Day Permanent Deletion

To ensure efficient resource reallocation and avoid server abandonment:

1. Automated Suspension on Due Date

If an invoice is not settled by its designated due date, the corresponding service is suspended immediately. Server connectivity, panel control, and public IP port forwards are stopped.

2. Permanent Deletion After 1 Week (7 Days)

A suspended service is maintained in our cluster for exactly 7 days (1 week) to allow late renewals. If the invoice remains unpaid after 7 calendar days of suspension, the server container, associated NVMe SSD storage volumes, databases, configurations, and all offsite backups are permanently destroyed and deleted. This deletion is irreversible.

Refund Terms Summary

Refunds are strictly governed by our dedicated Refund Policy:

  • Eligible Services: Game server hosting, bot hosting, and web hosting first-time purchases within 24 hours of purchase only.
  • Virtual Private Servers (VPS): Strictly non-refundable under all circumstances.
  • Payout: Issued directly to the original payment method.
  • Renewals, upgrades, add-ons, and domain purchases are non-refundable.

Support Scope: Free vs. Custom Paid Services

We pride ourselves on responsive, high-touch support, with typical response times within 30 minutes via Discord tickets and Instagram direct messages.

Included (Free) Support

  • Physical host node and network uptime
  • Pterodactyl & Client Area accessibility
  • Instant server reboots and console diagnostics
  • Complimentary server migrations from third-party hosts
  • Billing and payment inquiries

Custom / Paid Support

The following require dedicated engineering time and are available at an additional fee upon quotation:

  • Custom server development and scripting
  • Custom Minecraft plugin/modpack coding
  • Discord bot source code debugging and programming
  • Third-party web application development

Acceptable Use & Network Integrity

Users must not engage in any activity that harms infrastructure or third parties. Strictly prohibited activities include: DDoS attacks or booter/stresser operations, port scanning, cryptocurrency mining, malware or botnet hosting, email spamming, and copyright infringement. Violations will result in immediate termination without refund.

Backups & Data Loss Disclaimer

While Sparky Host provides automated off-site snapshot backups and one-click restore options in the control panel, the customer is solely responsible for maintaining secondary offline copies of their mission-critical data, world files, and databases. Sparky Host disclaims liability for data corruption, file system errors caused by faulty plugins, or accidental data deletions.

Limitation of Liability

To the maximum extent permitted by applicable Indian law, Sparky Host and its operator shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or business goodwill. In all circumstances, total aggregate liability shall not exceed the amount actually paid by you for the specific service in the preceding one (1) month.
